The administrative counseling is that a certain administration asks deterinined person or another administration for opinion before adoption a certain decision. This process leads to exchange views about any decision. fulfills principle of the participation in management the public utilities, and gives a relief to whom the decision was issued

There is a difference between jurists about the legal nature of the counseling opinion whether it is considered an administrative decision which accepts the appeal before the administrative judiciary independently or considered a substantial procedure of procedures the issuance any administrative decision and it is not appealable, but only the decision which has issued basing on the procedure is appealable because not taking the counseling opinion into consideration will lead to nullity the issued decision.

الاستشارة  الإدارية هي قيام الادارة باستطلاع رأي جهة معينة قبل اتخاذ قرار ما أن أخذ رأي فرد أو جهة معينة , يؤدي تبادل النظر بشأن هذا القرار وتحقيق مبدأ المشاركة في ادارة المرافق العامة , اضافة الى أنه يولد  الثقة في النفس في نفس من صدر بمواجهتهم .

وقد اختلف الرأي الفقهي حول الطبيعة القانونية لهذا الرأي الاستشاري , هل يعتبر قرار اداري ويقبل الطعن استقلالا؟ أم أنه يبقى مجرد اجراء من اجراءات اصدار القرارات الادارية وبالتالي لا يقبل الطعن , انما بالقرار الصادر بناء عليه .
