Arbitration of investment contracts, Investment plays an important role in achieving economic and social development of the host country. Countries have worked to enact legislation to regulate the establishment of these investment projects in an attempt to attract capital. One of these countries is Syrian Arab Republic, whose investment legislation encourages investment, whether in accordance with the Investment Law No. /10/ in the year of 1991, or the Investment Law No./8/ in the year of 2007. It involves a set of incentives that encourages investors to invest, specially the role of arbitration as one of the mechanisms for resolving certain types of disputes that arise out of an investment contract. This issue raised a set of questions about a set of points which we will study successively in our research, that is assigned for this purpose. However, we followed the inductive approach to analyze legal materials related to these points hoping to get answers to our multiple questions.

يلعب الاستثمار دورا مهما في تحقيق التنمية الاقتصادية والاجتماعية للدولة المضيفة, وقد عملت الدول على سن تشريعات تنظم بموجبها اقامة هذه المشاريع الاستثمارية في محاولة منها لجذب رؤوس الأموال ,ومن بين تلك الدول الجمهورية العربية السورية التي عملت تشريعاتها الاستثمارية على على تشجيع الاستثمار سواء كان وفق قانون الاستثمار رقم /10 لعام 1991/ أوقانون الاستثمار رقم /8 لعام 2007/ , ونص فيه على مجموعة من الحوافز التي تشجع المستثمرين على الاستثمار لعل ابرزها هو النص على التحكيم كاحدى اليات حل بعض المنازعات التي تنشب عن عقد الاستثمار , على ان هذا الايراد أثار مجموعة من التساؤلات لدينا حول مجموعة من النقاط التي سنقوم بدراستها على التوالي في بحثنا الذي خصصناه بهذا الصدد حيث سنعتمد في بحثنا على المنهج الاستقراني في تحليل المواد القانونية المتعلقة بتلك النقاط لعنا نصل الى اجوبة لتساؤلاتنا المتعددة.
