In this chapter, we examined the guarantees provided to the employee in the field of separation without the disciplinary route in Syria and Egypt. In two studies, we studied the previous procedures for the issuance of the decision of dismissal from service, which in turn divided into two requirements. In the second demand these procedures in Egypt, while in the second topic, the competent authority to issue a decision to discharge the service in both Syria and Egypt, and studied the subject in Egypt through the second demand.

تناولت في هذا الفصل الضمانات المقررة للموظف العام في مجال الفصل بغير الطريق التأديبي في سوريا ومصر وذلك في مبحثين, درسنا في المبحث الأول الإجراءات السابقة لصدور قرار الصرف من الخدمة والذي يقسم بدوره إلى مطلبين, درسنا في المطلب الأول الإجراءات السابقة لصدور ذلك القرار في سوريا, ودرسنا في المطلب الثاني تلك الإجراءات في مصر, بينما تناولت في المبحث الثاني, تحديد الجهة المختصة بإصدار قرار الصرف من الخدمة في كلا من سوريا ومصر, حيث تناولت دراسة موضوع الجهة المختصة بإصدار ذلك القرار في سوريا في المطلب الأول, ودرسنا ذلك الموضوع في مصر من خلال المطلب الثاني.
