Stipulating That Priority Should Not Be Given in Implementing Successive Treaties Related to The Same Subject (Nuclear Weapons Treaties as an Exampl)

| Abstract |
The relationship between successive treaties related to the same subject, such as successive treaties related to nuclear weapons, can take multiple forms, such as the desire of the contracting parties to deny the priority of any of the provisions of those treaties over others, or to deny its priority over any of the general provisions of international law that relate to the same subject. Accordingly, the research examines the case study in which the contracting parties wish to agree that the provisions of one successive general treaty related to the same subject shall not prevail over the other, in addition to studying the case in which the contracting parties move towards agreeing to adopt the text on the non-priority of the provisions of any of the successive general treaties. The general provisions of international law related to the same subject matter are based on the same subject matter regulated by those treaties, by following the deductive approach.

| الملخص |
يمكن أن تأخذ العلاقة بين المعاهدات المتتالية المتصلة بالموضوع نفسه، كالمعاهدات المتتالية المتعلقة بالأسلحة النووية، صورا متعددة، كاتجاه إرادة الأطراف المتعاقدة إلى نفي الأولوية لأي من أحكام تلك المعاهدات على الأخرى، أو نفي أولويتها على أيا من الأحكام العامة للقانون الدولي التي تتصل بالموضوع نفسه. بناء عليه، يتناول البحث دراسة الحالة التي ترغب بموجبها الأطراف المتعاقدة الاتفاق على عدم غلبة أحكام إحدى المعاهدات العامة المتتالية المتصلة بالموضوع نفسه على الأخرى، إضافة لدراسة الحالة التي يذهب من خلالها الأطراف المتعاقدة باتجاه الاتفاق على تبني النص على عدم أولوية أحكام أي من المعاهدات العامة المتتالية المتصلة بالموضوع نفسه على الأحكام العامة للقانون الدولي والتي تتصل بالموضوع نفسه الذي تنظمه تلك المعاهدات، وذلك باتباع المنهج الاستنباطي.
